Hi

I am an aspirant e-commerce and technology attorney residing in South
Africa. Hopefully you might all know that South Africa is currently going
through the drill of enacting its "e-Communications and Transactions Act".
The process is currently at its public deliberations stage under the
auspices of the Parliamentary Portfolio Committee for Communications.

Included in the 14 Chapter Bill is the Chapter on "DOMAIN NAMES".

In brief, Chapter 10 of the proposed Electronic Communications and
Transactions Bill seeks to establish a Domain Name Authority within South
Africa and give control of the .za domain to that Authority under the
auspices/control of the Department of Communications. Kindly note that the
.za domain has been under the current .za which had been founded by Mr. Mike
Lawrie.

1. Would anyone explain the technical factors related to RFC1591, if any.

2. Are there any commonly agreed upon protocols or commonly agreed upon
standards which should be adhered to?

3. Are there any redelegation procedures that have to be followed/adhered
to, e.g. the provisions of RFC1591 or ICP-1? i.e. the governance processes
which already exist, in particular for DNS.

4. What are the implications of not abiding by these standards? for
connection to the Internet, then the Internet will not connect to them.

5. What would happen were the current .za domain administrator will not
redelegate the
administration of .za to anyone else, in this respect the State of the
respective ccTLD?

6. Who determines the capability of a third party or a government in
fulfilling the requirements in
RFC1591 and IPC-1?
