This is a fair comment.  But I would suggest that an alternative structure doesn't exist because it hasn't been allowed to develop.  We are in a catch-22 situation if we follow this logic: without an opt-out policy we have no alternative management regime, yet without an alternative management regime we cannot accept an opt-out policy.

Proposal 136 doesn't solve everything but is merely the first step.  That said, I imagine multiple ways that an alternative regime might function following the adoption of 136:

The baseline, of course, is that without an alternative management structure an organization leaving ARIN would not have RDNS.  While many of us wouldn't choose this, I can imagine some address holders deciding it is an acceptable trade-off.

Beyond that, I imagine that some organizations might opt-out of ARIN in order to get support of another RIR.  Many legacy holders are global organizations, and this seems like a safe tactic.

Less certainly, it is possible that an alternative to the current registry system will take form.  This might be as complex as a registry/registrar system, such as the folks at Depository might advocate.  Or it might be as simple as ICANN allowing legacy holders to update RDNS zone files directly (e.g. based on the current RDNS zone management, which BTW is not the same as other TLDs).

Finally, I'd like to point out that proposal 136 as currently written would allow ARIN to offer RDNS service separately from Whois.  This isn't elaborated in the current text, but an organization might opt out of all services except RDNS if ARIN makes that option available.
