Yes, or we could just all meet at a common arena with our biggest geeks, and
they could rush in with their favorite weapons and fight for the stack of IP
certificates in the center of the arena.  

This is exactly what a p2p transfer policy does except that it uses dollars
and lawyers as the weapons.  Whoever can offer the biggest bribes gets the
goods.  Anyone who is not comfortable going to-to-toe with the big ISP's
budgets should be afraid, they should be very afraid.
