In that document, the claim of organized crime does not 
appear in the Statement of Facts (section II) but in the
Legal Argument (section III).

the lawsuit with its claim of organized crime, did
not succeed, as Exactis claimed it would in their 
injunction request. Instead, the case was dismissed.

Half truths and innuendo are not facts.
