If ARIN is incorporated in the USA then it is not exempt from US law. Any
individual or company always has the right to ATTEMPT to recover damages
by filing a lawsuit.
Now, it *IS* possible to give up that right by entering into a contract,
but in order for such contracts to be valid they have to made without
duress.
