Such activity leaves detectable artifacts both in the network and in the real world (e.g. solicitations for customers to utilize your leased IP space), and the risk of criminal prosecution for fraud if detected.

Is that sufficient deterrent? I suspect not when it comes to sizable address blocks (e.g. /18), but given that ARIN is now issuing no larger than a /22, it might indeed be sufficient deterrent.
