Not really.  At the moment, the legacy holder could not transfer those
addresses to the other party within the RIR system.  They'd have to
structure it as some sort of long-term lease, and then SWIP it to the other
party, or they'd have to go outside the RIR system completely to record the
transfer. (Which has a number of risks for both parties, and means WHOIS is
not kept up to date.)

Are you referring to APNIC prop-096 (Maintaining demonstrated needs
requirement in transfer policy after the final /8 phase) or ARIN-prop-156
(Update 8.3 to allow inter-RIR transfers)?
