Of course, one can get around all of this by leaking ULA-R (at the cost
of whois and reverse DNS). 

If anything, offering ULA-C, and demanding this kind of agreement seems
to give ARIN more power over ULA space, rather than less.

If you give out whois and rDNS, then ARIN also winds up with the power
to insert shaming statements into those databases.
