You are ignoring the context of the verbiage.

This verbiage strictly applies to what IP resources will be processed
in transfer transactions by ARIN if 2008-2 is adopted.

As such, it makes sense to specify that 2008-2 only applies
to resources which are administered by ARIN and where the
transferee would be eligible to receive their resources from
ARIN as a result of residing or operating a network within the
ARIN service region.

That is, I believe, the intent of the verbiage that sparked this
controversy.
