You're not comparing apples to apples.  You can hardly compare legalizing
murder to legalizing the sales of address resources.  Perhaps a more
realistic comparison would be legalizing marijuana and cocaine to stem the
drug war related violence we see in Mexico.  

Loosening transfer rules serves to help ensure transfers go through the RIR
and are properly cataloged.  More stringent transfer rules help to promote
alternative approaches to acquiring IP resources that don't necessarily get
cataloged.  You would be surprised how creative people get when the resource
is scarce and they need it (or the resource is scarce and they want to
monetize it).  This decreases the accuracy of the WHOIS database; not
something we want.  


P.S.  Finally, you got to use the word tautology in a sentence! ;-)

I'm just not sure what the advantage is.

We could eliminate the crime of theft by simply making it legal
to steal. Again, I'm not seeing an advantage.

The argument that a black market can be eliminated by legitimizing
a market without rules  is just such a tautology.
