As Leo mentioned, the intent here is to continue requiring applicants to 
prove they need IPv4 addresses, and simply provide them with another way

That is a valid concern.  ARIN counsel has been consulting with the AC 
on this policy proposal.  In addition to the legal risks to ARIN itself 
that he's been considering thus far, it may be a good idea to ask 
whether he feels this policy proposal would create any substantial legal 
risk for ARIN members individually.

Yes.  There is a large installed base for whom migrating to IPv6 may be 
painful (expensive).  Reducing the community's total expense for 
operating their IP networks is a benefit to the Internet community.

That assumes that we are only trying to reclaim existing unused IPv4 
space, without providing any incentive for people to renumber out of 
IPv4 space that, while not strictly unused, is easy to move out of.  For 
example, if I run a consumer ISP, I might decide that I could migrate my 
DHCP customers to IPv6 + NAT'd IPv4, thereby freeing up IPv4 addresses 
that I can then transfer to a slower adopter, and use the proceeds to 
fund my entire IPv6 migration.

Money is a powerful motivator.  If an organization can choose to save 
money by putting new hosts on IPv6 with NAT'd IPv4 or a proxy for 
reaching the remaining IPv4 Internet, they'll likely do so.  If a 
different organization with different issues can save more money by 
paying someone else to migrate and use their space to delay migrating 
until all their systems are ready, they'll likely do that.  This policy 
proposal allows organizations to choose what's best for them, rather 
than forcing a one-size-fits-all solution.

ARIN is in the stewardship business, no matter how grimy, gross, or 
messy that business becomes.  I believe it is our responsibility to the 
community to minimize the grime and messiness, and I believe that a 
transfer policy along the lines proposed is one of the best ways 
available to do so.

That is exactly what this policy proposal attempts to accomplish: it 
requires that any potential transferee justify their need for IP space, 
exactly as they have to do today.  They can then get IPv4 space from 
ARIN, if ARIN has any to give, or they can go out and find a transferor 
willing to part with some space.

One important point I'll reiterate: we're not talking about just 
"abandoned" or "unused" IP space here.  We're talking about providing 
organizations a financial incentive to reduce their usage of IPv4 space 
(such as by adopting IPv6), thereby freeing up space for other 
organizations who still need it.  To enable that, we need a new policy, 
such as the one we've proposed.
