ARIN-prop-148 LRSA resources must not be transferred to LRSA

ARIN received the following policy proposal and is posting it to the
Public Policy Mailing List (PPML) in accordance with the Policy
Development Process.

The ARIN Advisory Council (AC) will review the proposal at their next
regularly scheduled meeting (if the period before the next regularly
scheduled meeting is less than 10 days, then the period may be extended
to the subsequent regularly scheduled meeting). The AC will decide how
to utilize the proposal and announce the decision to the PPML.

The AC invites everyone to comment on the proposal on the PPML,
particularly their support or non-support and the reasoning
behind their opinion. Such participation contributes to a thorough
vetting and provides important guidance to the AC in their deliberations.

in section 8 of the NRPM

in clause 8.3

the following sentence is added:

The recipient of transferred number resources MUST sign the RSA with
ARIN if the resources being transferred are already under LRSA.
Resources under LRSA may not be transferred to a recieving organization
and placed under a new LRSA with that organization.  They must be placed
under the RSA, not the LRSA.

Rationale:

John Curran admitted in a recent posting to the PPML that the recent
Nortel to Microsoft address transfer resulted in the addresses received
by Microsoft being placed under LRSA, not RSA.

This indicates that ARIN interpreted section of 8.3 stating:

"...Such transferred number resources may only be received under RSA by
organizations that are within the ARIN..."

to mean ANY version of the RSA, be it LRSA or RSA.

Currently the community is engaged in a debate over this since
many people who supported the transfer section being added did
not support the idea that a recipient could get resources under
LRSA.

This policy proposal does not attempt to answer that debate.

However the fact that ARIN would interpret the manual in this
manner opens a loophole in that LRSA resources may be transferred
to recipients who would continue to demand that they remain under
LRSA, and the Nortel to Microsoft transfer indicates that ARIN
could allow such a transfer, since it is not specifically prohibited
in the NRPM.

This proposal still leaves the loophole that resources could be
received from "Legacy" holders and placed under LRSA.
