Im opposed to this proposal.

Strangulation by RSA doesn't need to occur and it would not improve the current address management situation.

ARIN-prop-152 RSA Modification Limits

ARIN received the following policy proposal and is posting it to the Public Policy Mailing List (PPML) in accordance with the Policy Development Process.

The ARIN Advisory Council (AC) will review the proposal at their next regularly scheduled meeting (if the period before the next regularly scheduled meeting is less than 10 days, then the period may be extended to the subsequent regularly scheduled meeting). The AC will decide how to utilize the proposal and announce the decision to the PPML.

The AC invites everyone to comment on the proposal on the PPML, particularly their support or non-support and the reasoning behind their opinion. Such participation contributes to a thorough vetting and provides important guidance to the AC in their deliberations.

Policy statement:

Add the following to section 8.1 of the NRPM

All transfers conducted under section 8 of the NRPM shall require the recipient to sign an RSA which provides at least the same limitations and restrictions as the standard RSA that would be used with any new allocation or assignment of number resources in at least the following
areas:

  a. Justified Need Requirements
  b. Subject to and Effect of NRPM 12
  c. Requirement for an annual fee to be paid
  d. Subject to future policy revisions adopted by the community

The above requirements may be waived to the extent necessary to meet a court order or settlement, but, such court order must be public or such settlement must include terms allowing the settlement terms to be published by ARIN, including the list of affected addresses and the exact resulting RSA. ARIN shall publish the terms of any such settlement and the resulting RSA within 10 days of drafting the settlement or RSA whichever comes later.

Rationale:

There have been a tremendous number of questions of late as to whether ARIN policies were followed and to what extent the modified LRSA issued to some transfer recipients allows such policy to be enforced. Since it is not possible to make the modified LRSAs public and it is not possible for the community to exercise any form of independent verification or validation of staff actions, this policy serves to provide guidelines and set limits on the extent to which an RSA can be modified to meet the needs of a transfer.
